AG Garland Receives Request to Invoke 25th Amendment

Representative Tenney cites the special counsel report that described President Biden as elderly with a failing memory.

U.S. Representative Claudia Tenney of New York sent a letter to Attorney General Merrick Garland recommending that the possibility of invoking the 25th Amendment of the Constitution to remove President Joe Biden from office be explored. Her letter came after Special Counsel Robert Hur described the president as a “sympathetic, well-meaning, elderly man with a poor memory.”

Representative Tenney called the special counsel’s report “alarming” and shared her grave concerns with Attorney General Garland. “After concluding that President Biden knowingly and willfully removed, mishandled, and disclosed classified documents repeatedly over a period of decades, Mr. Hur nevertheless recommended that charges not be brought against him.”

She wrote that the special counsel “recited numerous instances in which President Biden exhibited dramatically compromised mental faculties and concluded that a jury would be likely to perceive President Biden as a sympathetic and forgetful old man,” adding “selective prosecution is morally, ethically, and legally prohibited.”

Representative Tenney wrote that the president “needs to be charged, unless he is not mentally competent to stand trial,” and stated, “Special Counsel’s report makes a reasonable case that he is not.”

She continued that the president “most seemingly lacks the ability to execute his presidential responsibilities.”

“It is incumbent upon you to explore proceedings to remove the President pursuant to the 25th Amendment to the United States Constitution,” she wrote. “President Biden needs to be charged, or he needs to be removed.”
